Empower Educators and Communities

We call for a state strategy that directly addresses the challenges children face when using smart devices and accessing the online world. This strategy will establish clear objectives and measurable outcomes, including stronger protections for children's data privacy, age-appropriate content standards, digital literacy education, and accountability for tech platforms.

It must provide a roadmap for policy development, enforcement mechanisms, and cross-sector collaboration to ensure a safer digital future for every child.


Hawaii Laws Description
Hawaii Consumer Data Privacy Act (HCDPA) Enacted in 2023, the HCDPA provides Hawaii residents with rights concerning their personal data, including the ability to access, delete, and opt out of the sale of their information. For children under 13, the law mandates verifiable parental consent for data collection, aligning with the federal Children's Online Privacy Protection Act (COPPA). Additionally, for teenagers aged 13 to 16, explicit consent is required before their data can be sold or used for targeted advertising.
Student Online Personal Information Protection Act (SOPIPA) Passed in 2016, SOPIPA focuses on protecting the personal information of K–12 students.
Proposed Legislation: Hawaii Age-Appropriate Design Code Act (SB2309) Introduced in 2024, SB2309 aimed to establish the Hawaii Age-Appropriate Design Code, focusing on:​ Ensuring online services likely accessed by children are designed with their privacy and safety in mind. Creating a Children's Data Protection Working Group to develop best practices. Implementing penalties for non-compliance.​
Federal Framework: Children's Online Privacy Protection Act (COPPA) At the federal level, COPPA regulates the online collection of personal information from children under 13. It requires operators of websites and online services to obtain verifiable parental consent before collecting, using, or disclosing personal information from children.
